TERMS & CONDITIONS -

(Diesel Fitting & Auto-Electrical Services for Boats)

1. Definitions

 “Company” means the service provider issuing the quote and performing the work.

 “Customer” means the owner or authorised representative of the vessel receiving services.

 “Vessel” means the boat, engine, equipment, or components on which work is carried out.

 “Quote” means the estimated cost for labour, parts, and materials based on the information available at the time of assessment.

 

2. Quotes & Estimates

 2.1 All quotes are estimates only, based on preliminary inspection and information provided by the Customer.

2.2 Additional faults or complications discovered during the job may result in extra labour or parts not included in the initial quote.

2.3 The Company will notify the Customer of any additional work required where practical; however, urgent safety-related repairs may be carried out without prior approval.

2.4 Quotes are valid for 14 days unless stated otherwise.

 

3. Authorisation of Work

 3.1 By approving a quote—verbally, in writing, or by leaving the vessel with the Company—the Customer authorises the Company to carry out the work.

3.2 Where the Customer is not present at the time of repair (e.g., moored or stored vessels), remote approval via SMS, email, or phone is deemed sufficient.

3.3 The Customer warrants they are the legal owner or have authority to request repairs.

 

4. Parts & Materials

 4.1 The Company may use new, aftermarket, reconditioned, or OEM parts unless otherwise requested.

4.2 Any warranty on parts is subject to the manufacturer’s terms and conditions.

4.3 If parts need to be specially ordered, a deposit may be required.

 

5. Labour & Service Conditions

 5.1 Labour is charged at the current hourly rate, including travel to marinas, moorings, or boat ramps where applicable.

5.2 Marine environments may require additional time for access, removal, corrosion treatment, or diagnostic procedures.

5.3 The Company is not responsible for delays caused by weather, tides, vessel accessibility, or third-party suppliers.

 

6. Customer Responsibilities

 6.1 The Customer must ensure safe access to the vessel, including keys, mooring instructions, and any security codes.

6.2 The Customer must disclose any known issues that could affect the work, including electrical modifications, fuel contamination, or structural concerns.

6.3 The Customer is responsible for removing personal items from work areas.

 7. Payment Terms

 7.1 Payment is due upon completion of work unless prior arrangements have been made.

7.2 The Company may require deposits for major repairs or parts orders.

7.3 Vessels may be withheld until full payment is received (a repairer’s lien).

7.4 Interest or late fees may apply to overdue accounts.

 

8. Warranties

 8.1 Labour is warranted for 90 days from completion of service, unless otherwise stated.

8.2 Warranty applies only to the specific work performed and does not cover unrelated failures.

8.3 Warranty does not apply where:

  •  The vessel has been misused or neglected.

  •  Subsequent work is carried out by another party.

  •  Failures result from corrosion, water ingress, fuel contamination, or pre-existing conditions.

 

9. Limitations of Liability

 9.1 The Company is not liable for:

  •  Pre-existing faults or damage.

  •  Consequential or indirect losses (e.g., loss of charter income, towing, storage, delay).

  •  Damage caused by corrosion, poor previous repairs, or hidden defects.

9.2 The Customer acknowledges that marine systems may fail without warning due to factors outside the Company’s control.

 

10. Storage & Abandoned Vessels

 10.1 Vessels left on-site for more than 7 days after notification of completion may incur storage fees.

10.2 After 60 days of non-payment or lack of communication, the Company may take action in accordance with local repairer’s lien laws.

 

11. Sea Trials & Testing

 11.1 The Customer authorises the Company to operate the vessel (on land or water) as necessary for diagnosis and testing.

11.2 Fuel and launch fees for sea trials may be charged to the Customer.

 

12. Health, Safety & Environmental Conditions

 12.1 Work may be postponed due to unsafe weather, tides, or marina restrictions.

12.2 Hazardous materials (oil, coolants, filters) will be disposed of in accordance with environmental regulations and billed accordingly.

 

13. Cancellation

 13.1 Jobs cancelled after parts have been ordered or work has started may incur charges for labour, restocking fees, and materials.

 

14. Governing Law

 14.1 These Terms & Conditions are governed by the laws of the relevant state/region where the work is performed.
